14.1 Informal Resolution

The costs of arbitration shall be allocated in accordance with the applicable AAA rules, provided that we will pay any required arbitration fees for claims that do not exceed $10,000, as long as your claim is not frivolous as determined by applicable law.

14.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND IMOS PIZZA EACH WAIVE THE RIGHT TO PARTICIPATE IN CLASS-ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. All disputes must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights, proprietary information, or other confidential information.

In the event of a Force Majeure Event, we will make reasonable efforts to notify you as soon as practicable and to resume performance of our obligations as soon as the Force Majeure Event has been resolved.
